Some dumbe f**k today was speeding and hit my metro as I pulledout of a junction, I was half way accross the road and he obviously wasnt payin any atention, yet its my fault according to the insurance because I was the one pulling out.

THIS IS Sh*t, I NOW HAVE NO CAR!

Shouldn't be classed as your fault if recklessness can be demonstrated on the part of the other driver. Did you not manage to get any witnesses to say he was speeding?

Had the same happen to me a few years ago

its a no win situation, as if you say you pulled out because you didnt see him then they will say "if you didnt see him how do you know that he was speeding".. and if you say "he was speeding because you saw he was" they will say "if you saw him and you knew he was speeding, why did you pull out". they always say its the person joining onto the roads fault, just like its always the person who hits a car from the rear

Insurer's will always settle in favour of the vehicle on the major road. When you are pulling from a minor to a major road you must give way. Even if he was speeding, you would have to have appropriate evidence to back it up, even if you did the other parties insurers will always come back with 'You didn't give way' This claims scenario is a common one, and the driver on the minor road nearly always blames the driver on the main road for speeding, as thats the only straw they can pull. Unfortunately it will go down 100% your fault. Chalk it up as experience.

The Sh*t thing is, from the skid marks, which have now been measured as 18 yards (approx 52 ft), we could find out if he was speeding, a lot of witnesses say he was, as do other road users at the time, but even if it is proved he was speeding, its still classed as my fault, coz i pulled out from a minor road to a major one.

Yes your right, even if you can prove he was speeding, his insurers will still come back with 'Well you didn't give way' I doubt that your insurers would try and defend you. I didnt realise you were in Darlo!!!! Im in Newton Aycliffe!!

I thought that as soon as you exceed the speed limit you got the blame for everything, accidents you are involved in, anti-social noise, global warming, unrest in the middle east etc.

I didn't realise insurance people were so simple.

The right turn at the end of the road I live on in Manchester is a difficult junction. From the right the major road comes over a canal bridge and round a bend at the same time. Vision when turning out is limited thanks to a wall between turning and bridge. The limit is 30mph.
Now I can see the danger in this as anyone coming over the bridge above 40mph will have the car off balance and unable to brake before the junction and above 40mph the time between the car coming into view and crossing through the junction will be less than the time it takes to start off and cross the lane or get up to speed if turning out left. Now, when I make the move I go positively and quickly and not had a problem. But I can see the people who are more tentitive or aren't natural drivers (those who change to second almost as soon as they are moving and can't adapt to different situations) could come to grief here if they are unlucky enough to be caught out by a speeding driver and there are plenty of d1ckheads who come over the bridge too fast. There are plenty of junctions round the country that have similarly restricted vision.

OK most junctions have better visibility than this and people should be able to judge the approach of the car whether they are speeding or not. But as I've just described, I don't think a blanket rule works in every situation. Its a shame that insurance companies can't work beyond blanket rules, but I suppose its too much bother for them to investigate every contested case.

I agree with Barry, My cousin was involved in an accident involving restricted view minor>major and a speeding vehicle (turned out to be TWICE the limit). There were 2 off-duty police officers as witnesses yet my cousin got the blame, despite all the evidence and witnesses

One of my friends pulled out onto a major from a minor because the car coming towards him was turning in. He didn't see that someone was overtaking the guy who was turning in though, and got broadsided.

They rang insurance and found out that my mate was to blame, so he paid to have the car scrapped. Then insurance decided that it was actually 50/50 and the other guy was trying to claim for repairs to his car (which was a Sh*tty old Sierra). So my friend didn't get anything back, but I think that the insurance company told the other guy where to go as well.

Guess that's one of those difficult ones as they always say that if you're pulling out onto a major road it's your fault and also it you're overtaking it's your fault.

I believe that if a car is indicating to turn left into the minor road that I'm wating to turn right out of, and there is a car directly behind it waiting for it to turn then I'll give way to both vehicles before I turn, regardless of any speed both cars maybe travelling in. Many car's in this area overtake turning vehicles, even on chevrons. And, alas, even I've been known to do it. It's a dangerous manouvre expecially if a car is waiting to turn left out of the junction that car in front is turning right into. We can't pre-empt every car users judgement, but we can play the safety game.

You've learnt a nasty lesson there, just be fortunate that you only lost your car and not your life.

I know that everyone's supposed to play the safety game, but it's not always that easy. It's impossible on busy roads to wait until it's 100% safe to go all of the time, you'd have to wait for hours.
